Acceptance of the TermsBy participating in the Bitstamp Viva La Pizza Giveaway (“Giveaway”) you agree to accept and comply with these terms (“Terms”).CONSUMER NOTICE: You have not yet earned a reward. No purchase or payment is necessary to enter this Giveaway. You should read the entire Terms carefully before participating in the Giveaway.As used in these Terms, “Bitstamp” refers to Bitstamp Limited, a company incorporated under the laws of England and Wales, registered with the Registrar of Companies for England and Wales under the registration number 08157033, with its registered address at 5 New Street Square, EC4A 3TW London, United Kingdom, and its affiliated companies.Giveaway periodGiveaway will be active from 21 May 2024 at 12:00 pm CET until 26 May 2024 at 12:00 pm CET (“Giveaway Period”).Who can participate? Each natural person with X account who is above 18 years old can participate in the Giveaway, excluding residents of Afghanistan, Congo (Brazzaville), Congo (Kinshasa), Cuba, Hawaii, Iran, Israel, Libya, Nepal, Nevada, North Korea, Russia, Serbia, Spain, Somalia, Syria, Taiwan, the United Kingdom, Turkey, Ukraine (the “Participant”).Bitstamp’s employees and their immediate families, associated agents, and anyone personally connected with the Giveaway are not eligible to participate.How to participate?Giveaway will be held exclusively on Bitstamp’s official X account (https://twitter.com/Bitstamp), where tasks will be published at 24-hour intervals (the “Task(s)”). When a new Task is published, the previous one will close. There will be a total of five Tasks. Participants must successfully complete one or all Tasks within 24 hours of the Task being published to participate, as further described below:Participants who successfully complete any individual Task (but not all five) will receive a “Pizza Slice” for each Task they complete. Each “Pizza Slice” represents one entry into the raffle for a regular prize (the “Pizza Raffle”). Participants who have successfully completed an individual Task and who will be entered into the Pizza Raffle will be announced on Bitstamp X account within 24 hours from the Task being closed.Participants who successfully complete all five Tasks will receive a "Golden Pizza Slice". The “Golden Pizza Slice" represents one entry into the raffle for the grand prize (the “Grand Pizza Raffle”). Participants who have successfully completed all five Tasks and who will be entered into the Grand Pizza Raffle will be announced on Bitstamp X account within 24 hours after the Giveaway Period ends.Alternative method to participate for US customers only: Participants in the US may mail a postcard, including Participant’s complete name, mailing address (no P.O. Boxes), daytime phone number, email address, and birth date to: BITSTAMP USA, INC., Attn: Viva La Pizza Giveaway, 27 Union Square West, Suite 205, New York, NY 10003. Each postcard must be mailed separately for each individual Task and must be postmarked during the period when the individual Task is opened, starting 10:00AM UTC on May 21, 2024, and for entry into the Grand Pizza Raffle, all postcards must be received by 10:00AM UTC on May 26, 2024 (the “Mail In Entry”). Photocopied, illegible or mechanically produced entries are not eligible. All entries become the property of Bitstamp, and will not be returned, and no receipt of confirmation will be provided. Bitstamp is not responsible for lost, late, damaged, misdirected or postage-due mailed entries.To enter the Giveaway, the Participant is required to :follow @Bitstamp on X;complete at least one or all Tasks published on @Bitstamp X account, as described above.Participants may choose either to complete individual Tasks for entries into the Pizza Raffle or to complete all five Tasks to be entered into the Grand Pizza Raffle.After the Participant completes a Task, Bitstamp will verify if the Task has been completed correctly. The Participant will receive a “Pizza Slice” or the “Golden Pizza Slice” only if the Task(s) has been correctly completed.PARTICIPATION RESTRICTION: Each Participant may only participate once in each individual Task. Participants cannot participate in both the Pizza Raffle and the Grand Pizza Raffle. Any Participant using multiple X accounts or multiple Mail In Entries to participate in the Giveaway will be suspended. Non-compliance with any of these stipulated conditions will result in disqualification from the Giveaway.PrizeThe Winners of the Giveaway will receive either two Bitstamp branded items or one Bitstamp branded pack (together referred to as the “Prize”), as follows:Pizza Raffle Winners: apron, and “I <3 Bitcoin” baseball cap (the “Pizza Prize”);Grand Pizza Raffle Winners: Bitstamp pizza baking kit consisting of an oven mitt, apron, kitchen scale, cheese grater, and “I <3 Bitcoin” baseball cap (the “Grand Pizza Prize”).PRIZE DISTRIBUTION:Pizza Raffle Winners: Each Winner in the Pizza Raffle will receive one Pizza Prize.Grand Pizza Raffle Winners: Each Winner in the Grand Pizza Raffle will receive one Grand Pizza Prize.PRIZE RESTRICTIONS: Limit of either one (1) Pizza Prize or one (1) Grand Pizza Prize per Participant based on X account. Participants cannot win both a Pizza Prize and a Grand Pizza Prize.Total Prize Value: 2,321.50 EUR (2,520.20 USD).Selection of the WinnersThere are two categories of winners in the Giveaway (together referred to as the “Winner(s)”):Pizza Raffle Winners: A total of ten (10) Pizza Raffle Winners will be chosen at random in the Pizza Raffle from the pool of Participants who have successfully completed at least one (1) Task and maximum of four (4) Tasks and have received one (1) or maximum four (4) “Pizza Slice(s)”. The Pizza Raffle will occur within 24 hours after the Giveaway Period ends.Grand Pizza Raffle Winners: A total of three (3) Grand Pizza Raffle Winners will be chosen at random in the Grand Pizza Raffle from the pool of Participants who have successfully completed all five (5) Tasks and received a "Golden Pizza Slice". The Grand Pizza Raffle will occur within 24 hours after the Giveaway Period ends.After the selection of the Winners, the Winners will be vetted against the eligibility criteria of these Terms. Non eligible Winners will be disqualified, and other Winners will be selected in line with these Terms, as necessary. If no Winner satisfying the eligibility criteria can be found, Bitstamp reserves the right to not distribute the Prize.Notification to the WinnersBitstamp will reach out to the Winners by sending a direct message to the Winners on X, on Monday, 27 May 2024. Additionally, the Winners will be tagged in a post on Bitstamp X account announcing the Winners after the Giveaway Period ends. Bitstamp will provide the Winners with a link to our partner SwagHut platform (“SwagHut”) where the Winner will be required to complete a form with the information necessary for SwagHut to be able to successfully deliver the Prizes. All Prizes will be shipped within four (4) weeks after completing the form.ReservationsBitstamp may at its sole discretion at any time:disqualify the Participant and/or not award any Prize if the Participant violates these Giveaway Terms; undermines operation of the Giveaway; threatens other Participants and/or Bitstamp; or performs any other action deemed unfair by Bitstamp;modify the Terms and/or cancel the Giveaway;accept any other appropriate measures to protect legitimate operation of this Giveaway and Bitstamp’s interests.Limitation of liabilityTo the extent that it is permitted by law, Bitstamp excludes all liability whether arising in tort, contract or otherwise for any personal injury or any other loss or damage, including without limitation loss of opportunity or loss of profits, whether direct, indirect, special, or consequential, arising in any way out of the Giveaway, including, without limitation to:any technical difficulties or equipment malfunction (whether or not under Bitstamp’s control);any entry that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of Bitstamp;any tax implications; orthe Prize or use of the Prize.Data ProtectionParticipants hereby consent to processing of personal data by Bitstamp and SwagHut for the purpose of administrating the Giveaway and to distribute the Prizes to the Winners.All personal data are processed by Bitstamp in accordance with applicable laws and regulations.For any further information on how Bitstamp processes personal data, please refer to Bitstamp’s Privacy Policy.MiscellaneousIf any provision of these Terms become invalid, this shall not affect the validity of the remaining provisions.These Terms are governed by the laws of England and Wales, without reference to conflict of laws principles.
